Pixelwave Terms of Service - CODE47's Service Agreement

1. Acceptance of Terms

By accessing and using the CODE47 website and services, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

2. Services Description

CODE47 provides web development services including:

Custom website design and development
Landing pages and business websites
Website redesign and optimization
Ongoing website maintenance and support (optional)

The specific scope, timeline, and deliverables for each project will be outlined in a separate project proposal or agreement.

3. Client Responsibilities

As a client, you agree to:

Provide accurate and complete information about your project requirements
Supply all necessary content, materials, and assets in a timely manner
Respond to requests for feedback and approvals within reasonable timeframes
Make payments according to the agreed schedule
Ensure you have rights to all content and materials provided to us
Not use our services for any illegal or unauthorized purpose

4. Payment Terms

Currency & Pricing

All prices are quoted in Omani Rial (OMR) unless otherwise stated
Prices are valid for 14 days from the date of the proposal
Quoted prices are based on the project scope provided; changes may affect pricing

Payment Schedule

Landing Page (OMR 99): 100% payment upfront before work begins
Business Website (OMR 249): 50% deposit upfront, 50% upon completion before launch
Custom Website (From OMR 499): 50% deposit upfront, 25% at midpoint, 25% upon completion
Website Care Plan: Monthly plans billed at the start of each month; yearly plans billed annually in advance

Accepted Payment Methods

Bank Transfer (preferred)
Cash payment (for local clients)
Other methods may be arranged upon request

Late Payments

Invoices are due within 7 days of issue unless otherwise agreed
Work will be paused if payment is overdue by more than 14 days
Websites will not be launched until full payment is received
Repeated late payments may result in project termination

Refund Policy

Before work starts: Full refund minus 10% administrative fee
After work begins: No refund for completed work; refund only for work not yet started
Deposits: Non-refundable once work has commenced
Website Care Plan: Monthly plans can be cancelled anytime (no refund for current month); yearly plans are non-refundable but can be transferred

Additional Costs

Scope changes or new feature requests will be quoted separately
Rush delivery (less than 1 week) may incur a 25-50% surcharge
Third-party costs (domains, hosting, premium plugins) are charged separately at cost
Revisions beyond the included amount are charged at OMR 15/hour

5. Project Timeline & Delivery

We strive to deliver projects within 1-2 weeks for standard packages. Timelines may vary based on project complexity and client responsiveness.

Delays caused by late content delivery, feedback, or scope changes are not our responsibility and may extend the project timeline.

Force majeure events (natural disasters, pandemics, etc.) may affect delivery timelines without liability to CODE47.

6. Revisions & Changes

What Counts as a Revision

A revision is a minor change to existing content within the agreed scope. Revisions include:

Text edits (changing wording, fixing typos, updating information)
Image replacement (swapping one image for another)
Color or font adjustments within the existing design
Minor layout tweaks (spacing, alignment)
Updating contact information or links

What Is NOT a Revision (Requires Additional Cost)

The following are considered scope changes and are not included in your revision rounds:

Adding new sections to existing pages
Adding new pages not in the original scope
Adding new features or functionality (booking systems, payment, etc.)
Complete design overhauls or style changes
Adding additional languages (bilingual upgrade)
Changing the website structure significantly

Scope Changes

If your request goes beyond the original project scope, we will inform you that "This would require a package upgrade" or provide a separate quote for the additional work. We will never proceed with out-of-scope work without your approval and agreement on pricing.

Revision Guidelines

Number of revision rounds depends on your selected package
All revision requests must be submitted in writing (email or WhatsApp)
Please consolidate feedback — multiple small requests count as separate revisions
Revisions must be requested within 14 days of project delivery
Additional revisions beyond your package are charged at OMR 15/hour

7. Intellectual Property

Your Content: You retain all rights to content and materials you provide to us. You grant us license to use these materials solely for the purpose of completing your project.

Final Work: Upon full payment, you will own the custom website design and code we create for you. However, any third-party components, frameworks, or libraries used remain under their respective licenses.

Our Portfolio: We reserve the right to display completed projects in our portfolio and marketing materials unless you specifically request otherwise in writing.

8. Warranties & Limitations

We warrant that our services will be performed with reasonable care and skill. However, we do not guarantee:

That your website will achieve specific business results or rankings
Uninterrupted or error-free operation of your website
Compatibility with all future browsers or devices

Our liability is limited to the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either party may terminate a project with written notice. Upon termination:

Client must pay for all work completed up to the termination date
CODE47 will deliver work completed to date upon receipt of payment
Deposits and advance payments are non-refundable

We reserve the right to terminate services immediately if you breach these terms or engage in abusive behavior.

11. Governing Law

These Terms of Service are governed by the laws of the Sultanate of Oman. Any disputes arising from these terms or our services will be resolved in the courts of Oman.
